Second Stryker sales rep pleads guilty

The second former sales representative from a Hopkinton, Mass., medical device company has pleaded guilty to charges related to the misbranding of a medical device.

Justin Demming, who lives in Ohio, pleaded guilty Tuesday to a single charge of felony misbranding of a medical device, U.S. Attorney Michael Sullivan’s office said. According to the government, Demming “in his capacity as a territory manager for his employer, promoted the use of these devices in a manner that was different from the FDA approved use.”

Demming’s employer is not listed in court documents, but various references make it clear he worked for Stryker Corp. (NYSE: SYK). He faces up to three years in prison and a $250,000 fine at his June 3 sentencing, according to Sullivan’s office.

The guilty plea follows the November guilty plea of another Stryker sales representative. Darnell Martin admitted to similar activity. He is scheduled for sentencing May 13.

A Stryker spokesman did not immediately return a call Tuesday seeking comment.
