Medtronic Announces Infuse Settlements

Medtronic plc says it has reached an agreement with “substantially all” remaining claimants involving the Infuse bone graft product.

In a June 27, 2017 10K filing with the SEC, the company announced the agreements with approximately 6,000 claimants. The company also said it has set aside $300 million for “certain litigation charges” in the filing.

The company had previously disclosed reaching settlements in more than 4,000 Infuse patient lawsuits. In December 2016, a judge in St. Louis cleared the way for the first jury trial involving personal injuries allegedly caused by Infuse. That trial could have opened sealed internal documents that could have been used in other trials.

According to the Minneapolis Star Tribune, the company paid at least $85 million in a settlement to shareholders in 2012 to resolve allegations that it failed to reveal that most sales of Infuse were for off-label surgeries. In 2014, Medtronic said it paid $22 million to 950 injured Infuse patients. The company denied wrongdoing in each settlement.

Remaining Investigations

While the announcement settles private claims, the company is still under investigation by various state attorneys general who have issued subpoenas or document requests in Massachusetts, California, Oregon, Illinois, and Washington seeking more information regarding the Infuse device.

  1. I had cervical fusion and I would like to check eligibility I been having problems every since. I sind my the date of surgery and all the paperwork to a lawyer about the lawsuit.

  2. Had bone grafts in my neck in 2012 and was told in 2015 by another surgeon that my neck never healed. Also had a spinal fusion in 2015 in my l-4 and l-5 in 2015. Having severe pain in neck and lower back now and bad complications.

  3. Had 3 nine grafts in my neck that I found out from another surgeon never healed and I’m having a lot of health complications.

  4. My mother was infused without her authorization by a doctor who received money from Medtronics. No lawyer will take her case. Her eligibility to file a suit ends approx. 7 March 2018. I would like to check her eligibility to become part of this or other potential class action lawsuit.

    Hands.I hurt everyday.even when am sleep.i wake hurting. Go bed hurting.I have no life now.I hate i got this surgery.my love to eat has decreased, change in weigh.
    I was told it would help me.boy was I wrong. It’s so Painful I stay in bed constantly,Sunlight intensity
    My headaches. This Medtronic has not help me at all even there 3 bone grafts in my neck.what kind of life is this?

  6. I had the bone fusion surgery in 2010, I now have no life, expected to be on pain meds for the rest of my life. I am limited to around 10 – 15 minutes of being on my feet. No Dr will even see me now.
